Plea against Ashraf Jamali’s appointment dismissedPakistan
LAHORE: Chief Justice of the Lahore High Court Syed Mansoor Ali Shah dismissed a petition challenging the appointment of Justice Ashraf Jahan Jamali, wife of Chief Justice of Pakistan Anwar Zaheer Jamali, as judge of the Federal Shariat Court (FSC).
Dismissing the petition for not being maintainable, the LHC chief justice during the first hearing of the petition observed that the high court lacked jurisdiction to hear the matter and asked the petitioners to approach the Supreme Court.
Three advocates — Maulvi Iqbal Haider, Fawad Masood and Sheikh Nasir — had filed the petition alleging that rules and seniority of session judges had been violated in the appointment of Justice Ashraf Jamali (district & sessions judge) as additional judge of the Sindh High Court in 2013.
They said Justice Jamali was transferred to the Federal Shariat Court after a few months of her appointment as additional judge of the SHC without the approval of the parliamentary committee for judges’ appointment.
They said the president on Sept 1, 2014 extended for one year the tenure of Justice Jamali as additional judge of the SHC when she was working as judge of the FSC at that time.
Later, they stated, Justice Jamali was repatriated to the SHC as additional judge in Oct 2014 and was made a confirmed judge on Aug 26, 2015. The judge was again appointed to the FSC on Aug 28, 2015 in violation of the Constitution, they maintained. They said the procedure for the appointment of Shariat Court and high courts judges was different. They alleged that the CJP used his position for the appointment of his wife as judge of the FSC.
