New Delhi: The Patiala House court on Wednesday deferred Sanjeev Nanda's sentencing of till September 5.The court held him guilty on Tuesday for mowing down six persons including three policemen under his BMW car in January 1999.
The decision was taken after the defence and prosecution had a long argument in the court.
The prosecution in the BMW hit-and-run case sought the maximum punishment of 10 years' jail term for Sanjeev Nanda in Patiala High court.
"Deterrent punishment is the need of the hour, so that a right message is sent across the society to all future potential offenders," Public Prosecutor, Rajiv Mohan submitted before Additional Sessions Judge Vinod Kumar.
During the argument on quantum of sentence, the prosecutor referred to the adverse findings of the court against Nanda in its judgement delivered on Tuesday.
"According to the findings, criminal justice system has been tampered with by the mighty accused, who resorted to every unfair ways to botch up the trial. Hence, deterrent punishment of 10 years jail term be given to him so that in future, the mighty be refrained from polluting the justice
delivery system," Mohan added.
The court had on Tuesday held Nanda guilty under Section 304 (2) of the IPC- culpable homicide not amounting to murder - for killing six persons under his BMW car on the wee hours of January 10, 1999 at Lodhi Road in south Delhi.
Mohan also referred to the conduct of Nanda during and after the incident saying, "the drunken convict was driving the car at an excessive speed. After the incident not only he fled away but also tried to cause disappearance of evidence."
Opposing the contentions of the prosecutor, Nanda's counsel Ramesh Gupta pleaded, "It was a case of media trial. Some sections of the media projected Nanda as a culprit from the very beginning. In case of acquittal in this case, they could have said that it was a miscarriage of justice."
