New Delhi: In a case reminiscent of the story of just-released Amitabh Bachchan-starrer Hindi film Cheeni Kum, a 26-year-old woman is all set to formalise her marriage with a 74-year-old British national under the Special Marriage Act.
The go-ahead to the registration of the marriage was given by the Delhi High Court on Wednesday.
Justice B D Ahmed disposed of a petition filed by Umme Salma Ahmed from UP, challenging the Marriage Officer's order rejecting her application for registration of marriage under the special act on the ground that the couple had concealed that fact that they were married under the Muslim Act.
The court observed that the petitioner had wrongly invoked the provisions of Chapter II of the Special Marriage Act, which relates to the solemnisation of marriages.
"The couple should have invoked Chapter III, which relates to the registration of marriage celebrated in other form," Justice Ahmed added in his order.
"All the required conditions are admittedly fulfilled in this case and marriage can be registered under the Special Marriage Act," he observed.
The court directed the Marriage Officer to waive off the procedure of issuing one month's notice after they file the new application as the time was given to the couple.
According to the woman, in December last year both of them got married under the provisions of the Muslim Act and later filed an application for registration of the marriage.
The Marriage officer had issued notice of one month to both of them but then rejected their application. Finally, they had approached the High Court.
