New Delhi: The Delhi High Court on Wednesday asked the Centre to explain its stand on a PIL seeking direction to the Government to approach the President for a reference to the Supreme Court for its advise on the Indo-US nuclear deal.
Directing the Additional Solicitor General to make the Centre's stand clear before it, a Division Bench of Chief Justice M K Sharma and Justice Sanjeev Khanna fixed the matter for hearing on Thursday.
"Though the matter is important but we think this is at a premature stage. No issue is arising as the agreement is yet to be arrived by the government. However at this stage, we think there are certain things which are not clear and before passing any order the Centre has to make them clear to us," PTI quoted the Bench’s order.
The Bench has appointed senior counsel Jagmohan Sabharwal as Amicus Curiae to assist it.
The court wanted to know if there is any domestic law under which the Government would strike the deal or any Act it would bring to give effect to the agreement.
The Bench was hearing a PIL filed by a social worker Sarvjeet Kumar through his counsel Sugriv Dubey stating that the deal between India and the US is a legal matter and has an effect on the country's sovereignty.
"The executive cannot interpret the content of the agreement unless the Supreme Court goes into the details of the agreement and advise the government for the proper steps to be taken," the petitioner said.
