CUTTACK: The tendency of police to revel in success by allowing publication of photographs and airing of visuals of arrested persons in print and electronic media has drawn the attention of the Orissa High Court which has deemed it improper. A single-judge Bench of Justice CR Dash on Monday asked the police commissioner to apprise the court of how it benefits the police by making the identity of arrested public. Acting on a bail petition filed by one Sushil Kumar Tripathy, Justice Dash also directed the additional standing counsel SS Kanungo to inform as to why photographs of arrested persons are being allowed to be published in the media. As per case records, Tripathy was arrested by police earlier this year for alleged involvement in a case of dacoity in Bapuji Nagar area of Bhubaneswar. He moved the bail petition alleging gross violations by police during the conduct of his arrest and after. The accused persons should not be exposed to public before the test identification parade is conducted as per law, he maintained. In the bail plea, the petitioner produced a newspaper wherein his photograph had been published along with the police officer. On the basis of it, he questioned the legality of the identification claimed by prosecution in test identification (TI) parade. Considering the submission, the court also expressed displeasure and observed that due to such lapses on the part of the prosecution, the accused may be given the benefit of being released on bail.
