CHENNAI: The orders of the HR CE Commissioner granting sanction to construct a commercial complex on the land belonging to Sri Madanagopalaswamy temple near Periyar bus stand, Madurai and to entrust the entire complex to a single person have been quashed by the Madras HC.
Justice P Jyothimani quashed the sanction orders while allowing a writ plea from V Thiagarajan, president of Hindu Baktha Jana Sabhai in Madurai. Petitioner contended that the proposals were opposed to Sec 77 of the TN Hindu Religious Charitable Endowments Act.Rejecting the submissions, the judge observed that it was not the monetary benefit of the temple, which alone was relevant.

To acquire such benefit, the provisions of the Act should be adhered to. In any event, in a democracy, it was for the government and not for the HR CE Commissioner and the temple trustees to decide as to whether such monopolisation could be given to a particular individual, when admittedly the temple was under the control of the HR CE department.
