Yeddy's bail plea hearing adjourned to Wednesday
Former Karnataka chief minister BS Yeaddyurappa was indicted in the illegal mining case.

Bangalore: The Lokayukta court on Tuesday adjourned to Wednesday, the hearing on bail applications of former Karnataka chief minister BS Yeddyurappa and others regarding two complaints alleging irregularities in denotification of government land by him.

Special Lokayukta judge NK Sudhindra Rao adjourned the hearing after senior counsel for the complainant CH Hanumantharaya's objections to the submissions made by senior counsel for main accused (Yeddyurappa) Ravi B Naik remained inconclusive.

Submitting that a "prima facie case is made out against the accused and that it was a foolproof and impregnable case in which bail should not be granted" Hanumantharaya contended, "the way in which the file was moved and the rapidity with which denotification was done without the file being placed before the denotification committee is the moot point which shows that it was illegal".

Hanumantharaya alleged it was only during Yeddyurappa's tenure as the chief minister that the "largest number of denotifications were done".

Contrary to the submissions made be senior counsel for Yeddyurappa, Uday Lalit who appeared earlier, that "nothing was bypassed in the denotification", Hanumantharaya argued that the chief minister's office directly contacted other departments and the file was placed straight before the CM.

He further submitted that Yeddyurappa retained the Urban Development portfolio with himself as "he had an eye on the outskirts of the city".

To the objection filed by Naik that Lokayukta police did not register the complaint when the complainant approached it, Hanumantharaya argued that even before the Governor accorded sanction for Yeddyurappa's prosecution in the case, the ruling BJP was making preparations for a state bandh and no sooner was the sanction granted, it was called.

"So in these circumstances, how could Lokayukta police muster courage to register the complaint", Hanumantharaya asked.
