Aarushi-Hemraj case: CBI trains guns on Talwars
The CBI claimed the Talwars' maid, the guard and driver corroborated their 'last scene theory'.

New Delhi: The arguments on the framing of charges in the Aarushi-Hemraj double murder case began in a Ghaziabad sessions court on Tuesday. Aarushi's parents Rajesh and Nupur Talwar were present in the court.

The Central Bureau of Investigation (CBI) asked for Sections 302, 201, 203, 34 of the Indian Penal Code to be applied. These include charges of murder, false FIR, destruction of evidence and misleading the court and the probe.

The CBI claimed the Talwars' maid, the guard and driver corroborate their 'last scene theory' according to which there were four people living in the house and there was no sign of a fifth person's entry at the time of the murders. The CBI counsel said, "Four people were there, two died and two were left. When a murder takes place in a closed house and two are dead, then the onus shifts on those who are alive."

The CBI also claimed that Aarushi and Hemraj's injuries were identical. "The golf stick recovered from the house matches the injury. The Talwars refused to identify Hemraj's body and gave false information regarding the crime scene," teh CBI counsel said.

The Talwars' counsel claimed there was no direct evidence to prove the charges that the CBI claimed against the Talwars.

The court had on May 16 fixed for Monday the start of arguments on framing of charges against the dentist couple, after rejecting their for a month to study the prosecution documents before beginning of the arguments in the 2008 murder case.

Special Judge Lal had rejected Talwars' plea saying the Supreme Court has ordered expeditious trial. While Rajesh Talwar is out on bail, Nupur has been in judicial custody since April 30 when she surrendered before a Ghaziabad court on a direction by the Supreme Court.

14-year-old Aarushi was found dead with her throat slit at her Noida residence on May 16, 2008 and the body of Hemraj was recovered from the terrace a day later.
