CHENNAI: Investigation into the death of Sathish Kumar (24), son of advocate R Sankara Subbu, was transferred to the CBI by the Madras High Court on Thursday.The original postmortem report, dated June 15, expressed the opinion that Kumar, whose body was fished out of a lake at ICF, would appear to have died of shock and haemorrhage due to throat injuries, a bench comprising Justices C Nagappan and P R Sivakumar noted.It was also alleged by the Bar that top police officials had given press reports even before the autopsy was conducted, to the effect that no external injury was found on the body of Kumar, a law graduate, with a view to screening the offenders. “In such circumstances we are of the view that the investigation of the case has to be entrusted to the CBI,” the bench observed.Earlier, Advocate-General A Navaneethakrishnan told the bench that the State government had no objection to the transfer of the probe to the investigative agency.Petitioner Sankara Subba had made allegations against certain police officials and raised the suspicion that the said officials might have been involved in the occurrence since they were aggrieved by orders obtained by him in another case, wherein compensation was awarded to the victim therein for illegal detention.Subbu had also alleged that he was threatened by the said police officials with dire consequences, the judges noted.The bench directed the inspector attached to Thirumangalam police station, who was hitherto handling the case, to hand over the entire case papers to the joint director, CBI, in Chennai. The CBI director in New Delhi should nominate officer/officers to conduct the investigation and the same should be commenced immediately, the bench added, and posted after two weeks the main habeas corpus writ petition praying for a direction to the police to produce Sathish Kumar in court and to set him at liberty.
