CHENNAI: The operation of a GO dated December 26 last year of the School Education Secretary directing the schools in the State to compulsorily form school management committees, was stayed by the Madras HC on Tuesday.Justice S Rajeswaran granted the interim injunction for four weeks, while admitting a writ petition from the Tamil Nadu Catholic Educational Association, Santhome, Chennai, seeking to declare certain provisions of the TN Right of Children to Free and Compulsory Education Act, 2009, as unconstitutional and inapplicable to the over 2,400 schools run by the association.Among other things, the petitioner contended that the governemnt order (GO) infringed upon the right of the minorities to administer educational institutions by interfering with the right to constitute its own governing body for management of the school.  “It would take away the right to disciplinary control and action over the employees. It usurped the constitutional right of administration.
