HYDERABAD: A division bench of the High Court comprising chief justice Nisar Ahmad Kakru and justice Vilas Afzalpurkar on Friday refused to act on the allegations made by textiles minster P Shanker Rao against his cabinet colleagues Sabita Reddy and M.Venkataramana.The bench faulted the approach by a single judge who had earlier treated a news item in this regard as a writ petition.Shanker Rao admitted in subsequent reports that he had in fact made the allegations.The single judge voiced serious concern at the allegations made by one cabinet minister against his own colleagues and said that it was in the interest of the system that an inquiry be conducted into the matter.Advocate-general Sudershan Reddy informed the court that this was not a matter that required the court to exercise its powers of PIL and entertain the matter.The chief justice pointed out that the single judge erred in relying only upon newspapers and said that such intracabinet bickering, if taken as writ petitions, would be at public cost of time and resource.The bench also dealt with the order of the single judge and said that it left nothing to the division bench but ensuring its execution. The bench said ‘such practice’ was contrary to the rules and procedure and made it clear that such an approach was incorrect.Doing away with Group-II interviews challengedJustice L Narasimha Reddy admitted a writ petition filed by D Guru Maheshwar Reddy and five others questioning the government order made in July this year doing away with interviews in the selection of candidates for the Group-II Services.The judge recorded the statement of the additional advocate-general that there was no need for stay at this stage as there was no notification for recruitment but made it clear that it was open to the petitioners to renew their application if the need arose.The petitioners alleged that the approach of the government in issuing such an executive fiat and a direction to the constitutional body, the APPSC, was unconstitutional.
