BANGALORE: Two days after a single judge cleared the hurdles for the construction of Metro station at Yeshwanthpur, the petitioner again moved the court on the same petition and a division bench issued a stay order on the construction work.The petitioner, G M Babu, a city based industrialist had challenged the land acquisition order dated May 23, 2008 to acquire 991.93 sq meter land at Survey No 26/4B belonging to him at Yeshwanthpur.In his submission, he said that he is conducting his business in the place since 1976 and has been sanctioned loan to extend his business. He further submitted that there was no plan to construct the Soap Factory station earlier and had been to meet Special Land Acquisition officer (SLAO) after a notice from him and had objected to the manner of acquisition.He stated that the SLAO, without considering his objection nor conducting inquiry, had passed an order, which he alleged, was arbitrary, illegal and without jurisdiction.He sought to quash the SLAO’s acquisition order as the proposed land is not feasible for establishing railway station as it is surrounded by other properties and buildings.The division bench comprising Justice Manjula Chellur and Justice S N Satyanarayana stayed the construction work of Metro station.
