New Delhi: The Supreme Court on Thursday dismissed a review petition seeking transfer of cases against Opposition leader and senior BJP leader L K Advani and seven others in the Babri Masjid demolition case.
A Supreme Court Bench, headed by Chief Justice K G Balakrishnan, dismissed a petition by Mohammed Aslam alias Bhure seeking the transfer of the case from Rae Bareilly to Lucknow.
The Bench held that there was no need to review the earlier judgement.
Mohammed Aslam, who had also approached the apex court before the demolition of the disputed structure, had sought review of the November 2002 verdict clearing the holding of trial of two cases at two separate courts at Rae Bareli and Lucknow.
CBI had taken a stand that since the two cases arise from the same incident and a consolidated chargesheet having been filed, it would be in the interest of justice that both cases be tried together at Lucknow.
The Rae Bareli court is holding trial against eight accused including senior BJP leaders L K Advani, M M Joshi, Vinay Katiyar and expelled BJP leader Uma Bharti. The trial is also against VHP leaders Ashok Singhal, Vishnu Hari Dalmiya, Giriraj Kishore and Sadhwi Rithambhara.
The Rae Bareli court had in September 2003 quashed the charges against Advani while deciding to proceed against other seven persons. The judgment on the review petition was reserved on August 29, 2006.
The Supreme Court on September 28, 2002, had held valid a notification issued by then Mayawati government separating the cases against the eight leaders and transferring them to Rae Bareli for trial by a special CBI court.
