KARWAR: The people of Nakhuda Mohalla in Devbag village near Sadashivgad protested the proposed conversion of 31 acres and 29 guntas of residential area in the village into an industrial zone by Karwar Urban Development Authority (KUDA).The move is to establish a private industry by a firm, M/S Fyboplast, based in Noida in Uttar Pradesh.The villagers submitted their objection statement to the KUDA against the notification issued by it in a local newspaper in this regard.K R Desai, legal advisor and also the president of District Citizens' Welfare Association, told reporters on Friday that the suggested area was declared as residential zone under Comprehensive Development Plan (CDP) prepared by the KUDA and approved by the government in 1998. There is no authority or jurisdiction even for the government to allow the change of user once CDP comes into operation under Karnataka Town and country Planning Act, 1961. He said the High Court, in one of its judgements, observed that the decision taken under CDP is strictly binding on the government and its agencies as per rule 30 of Karnataka Planning Authority Rules of 1965.He pointed out that owners of the land had not given application for the conversion of their land into industrial zone. The applicant, M/S Fyboplast, is a stranger to this place; therefore, the firm has no legal right to claim the conversion. The KUDA issued the notification without consulting the owners,. This was a conspiracy hatched by the officials of the KUDA in connivance with the firm, he alleged.Trees felledDesai said many mangrove trees have been felled on the land to clear the area without the Forest Department's permission. He urged the department to initiate criminal proceedings on the firm and stop imposing fine.He said KUDA had not mentioned in its notification about the type of industries coming up in the area.
