Mumbai: In a new twist in the legal battle for the custody of Bollywood star Aamir Khan's brother Faisal Khan, the younger Khan told a Mumbai court on Monday that the superstar does not have time for him.
Faisal, suffering from mental illness, is currently living on his own. Mumbai Metropolitan Magistrate Pankaj Shah, who is hearing the application filed by Aamir Khan, seeking Faisal's custody, said the matter will be decided on February 15.
Aamir's application says Faisal is of unsound mind and he needs medical attention and, as such, he should be in the custody of a family member. In the alternative, Fasal should be sent to a reputed government hospital for the treatment of mental condition, Aamir has pleaded.
"It is not safe for Faisal to continue living in society without proper medication and expert medical supervision as he can get violent and harm himself and others," Aamir said.
The court asked Aamir's counsel Mihir Gheewala if there was any other relative who could take Faisal's custody. Gheewala said there was none else who had the resources to take care of him.
Faisal, who was present in the court, countered Gheewala, saying "Aamir doesn't have time for him because he is a superstar." Faisal's lawyer SA Vasid told the court that Faisal is constantly under treatment at JJ Hospital and doctors had not asked him to take any medication.
Interestingly, Faisal had voluntarily got himself examined at the KEM hospital. KEM's report dated November 22 last year says Faisal is 'behaviourly well maintained' but adds that he is suffering from paranoid schizophrenia.
The custody battle began, after Faisal said that Aamir had made him a prisoner in his house and was forcing him to take medicines for paranoid schizophrenia, although he was perfectly normal.
After a bitter court battle, the metropolitan magistrate court had on October 1 awarded Faisal's custody to Tahir Hussain, overruling Aamir Khan's claims. But days later, Tahir Hussain moved the court, saying he was unable to take care of his younger son and that his custody should be given to his elder son Aamir Khan.
Since then, Faisal has been staying alone at a rented home at Tilak Nagar, an eastern suburb of Mumbai.
