The Delhi High Court on Tuesday remanded Bollywood actor Rajpal Yadav to 10 days judicial custody for concealing facts about a Rs 5 crore recovery suit filed against him and his wife by a Delhi-based entrepreneur.
Justice S Murlidhar also asked Yadav's wife to remain present in the Registrar General's office till the rising of the court.
The judge also issued a contempt of court notice against two women lawyers representing the couple and an oath commissioner, as they submitted an affidavit in the court on Monday with forged signature of the couple.
The court was irked by the conduct of the couple and counsel for repeatedly concealing the fact on December 2 from the court, saying that Yadav's wife Radha was in Ghaziabad and would reach court.
The couple had to present themselves before the court on Monday. Rajpal Yadav was there for some time. Radha was in Mumbai but their counsel told the court that she was in Ghaziabad.
The court posted the matter for Tuesday, asking both of them to remain present. The couple were present on Tuesday in the court from where Yadav was taken to the jail and his wife was sent to the Registrar General's office.
The court said it took lenient view for his wife, as she had a small child with her.
"As far as defendant no. 3 (Radha) is concerned, court takes lenient view as she has a child with her. She will be in the room of the Registrar General till the closing hour of the court," Justice Murlidhar said.
Sending Yadav to 10 days judicial custody, the court said: "The court sentenced 10 days simple imprisonment to Rajpal Yadav and direct the police to take him into the custody."
The court also ordered attachment of assets of the couple, and attached his bank account of the Axis Bank and a company owned by him.
Yadav and Radha are facing legal trouble after a Delhi-based entrepreneur, MG Agarwal (owner of Murli Projects), filed a case against them in the high court for failing to repay a loan of Rs 5 crore, which the actor took in 2010 to make his Hindi debut directional film "Ata Pata Laapata".
