HC dismisses pleas of MBBS students to bar re-counselling

The Madras High Court, on Monday, dismissed the pleas filed by seven MBBS aspiring candidates, belonging to MBC and BC Muslims, holding that if counselling was re-done, it will be against the students placed more meritorious than the petitioners.

The petitioners sought a direction from the court to treat them as candidates having been selected under the quota. The First Bench, comprising acting Chief Justice RK Agrawal and Justice M Sathyanarayanan, said cut-off marks obtained by the candidates belonging to MBC category are less than the cut-off marks of the last candidates selected in the category.

The petitioners sought admission for MBBS course, alleging they had been denied admission unfairly because of the second counselling after the state got additional MBBS seats from Medical Council of India, which was not properly conducted.

Rejecting the contention, the Bench said "if the contentions of the petitioners are to be accepted, then the entire counselling has to be re-done and it would have a cascading effect on the entire seniority and admission of MBBS course."

It will be not only against students who are meritorious than the petitioners but also affect the reservation component of other categories, which will have a cascading effect, the bench said.
