The Kerala High Court on Wednesday sought the view of the state government on the bail plea of CPM Kannur district secretary P Jayarajan, who is the 38th accused in the Shukkoor murder case.
Justice P S Gopinathan issued the directive and adjourned the hearing to Monday.
In his petition, Jayarajan said that he had been falsely implicated in the case and charged under Section 118 (concealing design to commit offence punishable with death or imprisonment for life) of the Indian Penal Code.
The High Court had earlier denied bail to Jayarajan. Counsel for the petitioner M K Damodaran said that the investigation in the case is almost over, and it was learnt that the police will file the chargesheet within two or three days. “He had appeared twice before the SIT for hours on end. Later, he was arrested, and the Magistrate remanded him in judicial custody. Continued detention of the petitioner is not at all required in the case. The state is getting sadistic pleasure by opposing the bail application,” he said, adding that the petitioner has to attend the marriage function of his close relative on August 30.
He also pointed out that T V Rajesh MLA, who was arrested for a similar offence, was granted bail.
Appearing for the state, Director-General of Prosecutions T Asaf Ali vehemently opposed the plea. “If the petitioner is released on bail, it will affect the investigation,” he said. The reason for which Rajesh was granted bail will not be applicable to Jayarajan, Asaf Ali submitted.
