THIRUVANANTHAPURAM: The controversy surrounding R Balakrishna Pillai has also slapped a legal notice on Chief Minister Oommen Chandy. Mahesh Mohan, a law student of Delhi University, has served the notice on Chandy through his lawyers Thrissur Law Firm for violating the Oath of Office and showing favouritism towards Pillai. A special order in August allowing Pillai to be admitted to a private hospital was in violation of the Kerala Prison Rules 1958. The Chief Minister had done so without `any valid reason or explanation’ using his position in favour of Cabinet colleague and Pillai’s son K B Ganesh Kumar. Though the SC had sentenced Pillai to rigorous imprisonment, ``because of your interference there was nothing rigorous about the sentence he served. He was permitted food from home, and was provided with a cot, bed, mosquito repellant, even an air cooler in violation of the provisions of law. It is also to be noted that the Kerala Prison Rules, 1958, specifically bars `A-Class’ facilities to those convicted for corruption,’’ the petitioner said, adding that Pillai was even allowed the use of personal mobile phone. The petitioner has demanded the Chief Minister to withdraw the above order and send Pillai back to prison. A medical board with doctors from outside the state should be constituted to conduct an independent examination of the patient, he said.
