New Delhi: The Supreme Court has issued notices to the Centre and the Human Resource Development (HRD) Ministry on a petition filed by an IIM alumni.
The petition challenges the policy of giving 27 per cent reservation to Other Backward Classes in the country.
Despite the notices, the Supreme Court has said that Tamil Nadu can create extra seats for general candidates in educational institutions every year.
Earlier, the Tamil Nadu government -- which is supporting the OBC quota -- moved an intervention application through counsel V G Pragasam seeking to be heard in the matter.
Tamil Nadu has claimed that it was a pioneer in extending reservation benefits to the SCs, STs and OBCs in the state and hence its views has to be considered by the Apex Court before passing any judgement.
The Rashtriya Janta Dal -- led by Railway Minister Lalu Prasad -- has also filed a petition seeking to be impleaded in the quota hearing.
SC has listed for May 8 hearing on the Centre's plea for vacating the stay passed by the court against implementation of the quota policy in elite Central educational institutions like IIMs and IITs during the present academic year.
A Bench of Justices Arijit Pasayat and L K Panta had earlier stayed the implementation of the 27 per cent reservation benefits for OBCs, until the matter was disposed of.
The issue had assumed considerable political overtones with the UPA Government seeking an early hearing of the matter and also urging the apex court to refer the issue to a Constitution Bench since it involved substantive issue of law governing the policy of reservations for various segments of the society.
