New Delhi: Relief for Tamil Nadu Chief Minister J Jayalalithaa, the Supreme Court has directed the Karnataka government to cancel the removal order of Special Public Prosecutor Bhavani Singh in her disproportionate assets (DA) case. The Karnataka government had dropped Bhavani Singh as SPP in the case. It had led to a huge controversy and Jayalalithaa had moved the SC alleging political motives behind it.
The DA case was transferred from Chennai to Bangalore by the Supreme Court in 2005. Jayalalithaa's counsel Shekhar Naphade had argued that the motive behind the change in prosecutor was to delay the trial at the final stage.
The Karnataka government through Attorney General GE Vahanvati had argued that the appointment of Singh too did not appear to be above board. The AG handed over the communication from the high court to defend his claims.
The trial of DA case against Jayalalithaa has already seen many controversies. Former Karnataka Advocate General BV Acharya who had quit as SPP in the case in August 2012, had alleged that he was harassed by the BJP leaders in the state. He was persuaded to continue by the Chief Justice of the Karnataka High Court. After the Chief Justice of Karnataka High Court was appointed as a Judge of the Supreme Court, Acharya quit as SPP. In his place Bhavani Singh was appointed.
After the Congress government came to power in Karnataka, it had dropped Bhavani Singh as SPP. Jayalalithaa had challenged the decision and the court had stayed the decision asking the state to consult the Chief Justice of the high court. After consulting with the Chief Justice, the state government on September 15 issued notification dropping Singh.
